1. Acceptance of Terms
By accessing or using the CybersecCloud platform and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, you may not use the Service.
2. Account Terms
When you create an account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your account credentials
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized access or security breach
3. Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to violate any applicable law or regulation
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any portion of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to access the Service without our written consent
- Resell, sublicense, or redistribute the Service without authorization
4. Intellectual Property
The Service, including its design, features, content, and underlying technology, is owned by CybersecCloud and protected by intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely as necessary to provide the Service.
5. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. You acknowledge that you are responsible for the data you upload and share through the Service, including ensuring you have the right to share vendor assessment information.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for scheduled maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
7. Limitation of Liability
To the maximum extent permitted by law, CybersecCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless CybersecCloud and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
9. Termination
Either party may terminate the use of the Service at any time. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases, and you may request export of your data within 30 days.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
